The family of a cinematographer shot and killed on the set of the film “Rust” is suing Alec Baldwin and the movie’s producers for wrongful death, their attorneys said Tuesday.
Lawyers for the family of Halyna Hutchins announced the lawsuit filed in New Mexico in the name of Hutchins’ husband, Matthew Hutchins, and their son, Andros, at a Los Angeles news conference.
At a news conference announcing the lawsuit, attorneys for the husband and 9-year-old son of Halyna Hutchins said that Baldwin refused training for the type of “cross-draw” he was performing when he fired the shot that killed her.
Hutchins was fatally shot last October during a rehearsal for a scene for the film, which was being shot near Santa Fe, New Mexico. Director Joel Souza was also injured in the shooting which occurred when Baldwin practised a draw with a revolver and fired the weapon.
Last month Baldwin turned over his cellphone to investigators, and Dyer said he continues to cooperate fully with the investigation.
In an interview with ABC News in December, Baldwin said he felt incredible sadness over the shooting, but not guilt.
“Someone is responsible for what happened, and I can’t say who that is, but it’s not me,” Baldwin said.
